The Federal Aviation Administration needs to overhaul its rules and regulations and stop hurting general aviation. Lawyers Need More Rules and Regulations

I am of the opinion and many who study the legal industry or know from first hand knowledge that most lawyers are crooks. To prevent the lawyers and attorneys from ripping off the American people, corporations and government monies, which impact consumers, taxpayers and employees we must monitor or the legal profession more closely.

NFPA-70E Compliance Takes More Than A Label

Since the release of IEEE-1584 in September 2002 and NFPA-70E, 2004 Edition, I have talked with hundreds of facility engineers concerned about NFPA-70E arc-flash hazard compliance. NFPA, the IEEE Safety Committee, and other groups have done a great job of spreading the word regarding arc-flash hazards and the need to address this specific safety issue. Unfortunately, most engineers I have spoken with are under the misconception that if they label equipment for arc-flash hazards, and enforce the use of personal protective equipment (PPE) per the label, they are in compliance with 70E and OSHA requirements. Nothing could be further from the truth. Arc-flash hazard labeling and PPE compliance are only a small part of 70E compliance and even a smaller part of a properly defined safety program.

HIPAA and Email - How Does Your Practice Deal with Compliance in a Digital Age?

Email as a communication solution for the smaller clinic can be a time-saving resource. It can replace the many phone calls and postal mailings, adding a financial benefit to the smaller clinic. However, some healthcare practitioners feel that emailing their patients equates to working for free, but some clinics have already adopted charging for email consultations. At some practices, patients pay a flat rate from $100 to several hundred dollars per year for this type of service. This article addresses email in the digital medical office and ramifications of HIPAA Compliance.

Landmark Ruling in Trade Mark Case - Test for Invalidity

In Special Effects Limited v L'Oreal & International Trademark Association (Intervener) [2007] EWCA Civ 1, the Court of Appeal overturned the decision of the Chancery Division of the High Court. The case concerned an opposition to a trade mark registration. The Court in the first instance held that there was no relevant difference between the practice and procedure of the Trade Mark Registry in opposition proceedings under s 38(2) of the Trade Marks Act 1994 and invalidity proceedings under s 47(1) of the Act. The issues in dispute in the two sets of proceedings were identical.

Trademarks are names, phrases, logos or images used to uniquely identify your company and your products and services. Because trademarks are used in businesses, there are rights you can claim to protect your company, and there are governing bodies that regulate the use of your trademark. In the United States of America, the governing body called United States Patent and Trademark Office (USPTO) is the governing body that makes your trademark and patented product unique. They guarantee that no other company can carry the same name, logo or product without proper approval from you.

Trademark is a very important part of your company. It differentiates your company from the rest that are in the same category or with those that have identical or almost the same name as your company. It also differentiates you from companies that bear a logo or company seal that represents your establishment. Nowadays, jingles are also used to uniquely distinguish a company.
